These Terms of Service govern access to arquemar.com and purchases from ARQUEMAR. By using the website or placing an order, you agree to these Terms. If you do not agree, do not use the website. Mandatory consumer rights in your location continue to apply and take priority where they cannot lawfully be limited.

Eligibility and account information

You must be legally capable of entering a binding contract in your location, or use the website with the involvement of a parent or legal guardian. You agree to provide current, complete, and accurate account, billing, delivery, and payment information and to protect any account credentials.

Products and responsible watercraft use

Product images and colors may vary slightly by screen, production batch, and lighting. Specifications, availability, and included components are described on the applicable product page and may be updated before purchase.

Watercraft and marine equipment must be assembled, inspected, maintained, and operated in accordance with the supplied instructions and all applicable boating, registration, licensing, environmental, age, capacity, flotation-device, and safety requirements. Conditions on water can change quickly. Customers are responsible for evaluating local conditions, using suitable safety equipment, and operating products within their intended limits. Product information does not replace training, professional advice, or legal requirements.

Orders and acceptance

An order confirmation acknowledges receipt of your order but does not necessarily mean that it has been accepted. We may decline or cancel an order for legitimate reasons, including inventory error, suspected fraud, pricing error, payment failure, shipping restriction, or legal requirement. If we cancel after payment, we will refund the affected amount.

Prices, payment, and taxes

Prices and available currencies are shown at checkout and may change without notice before an order is placed. You authorize the selected payment provider to charge the full order total. You are responsible for taxes, duties, fees, and currency-conversion charges unless checkout states they are included.

Limited warranty and legal guarantees

Any product-specific written warranty displayed at purchase or supplied with the product applies according to its stated coverage, exclusions, and duration. Except to the extent prohibited by law, the website and products are otherwise provided subject to the descriptions and express warranties made available at purchase. Statutory warranties, guarantees, and remedies that cannot legally be excluded remain unaffected.

Acceptable use

You may not use the website to violate law, infringe intellectual property or privacy rights, transmit malicious code, interfere with security, scrape or exploit content without authorization, submit false information, impersonate another person, or conduct fraudulent or abusive activity. The ARQUEMAR name, branding, website design, photographs, text, graphics, product presentation, and other site content are owned by or licensed to ARQUEMAR and protected by applicable intellectual-property laws. Personal shopping use is permitted. Reproduction, resale, modification, or commercial exploitation without written permission is prohibited.

Certain website functions may be provided by third parties, including payment, hosting, analytics, and delivery providers. Their separate terms may apply to your direct use of their services. We are not responsible for third-party websites or services beyond responsibility that applicable law imposes on us.

Disclaimers and limitation of liability

To the fullest extent permitted by law, ARQUEMAR is not liable for indirect, incidental, special, consequential, or punitive loss arising from use of the website or products, including loss caused by improper assembly, unsafe operation, failure to follow instructions, unauthorized modification, or use contrary to law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, willful misconduct, or other protected claims under applicable consumer law.

Indemnity

To the extent permitted by law, you agree to indemnify ARQUEMAR against third-party claims, losses, and reasonable costs arising from your unlawful use of the website, violation of these Terms, infringement of another person's rights, or unsafe or unauthorized use of a product. This provision does not apply where prohibited by consumer law.

Changes, severability, and waiver

We may update these Terms prospectively by posting a revised version with a new effective date. Terms applicable to an accepted order will not be changed retroactively without a lawful basis. If any provision is found unenforceable, the remaining provisions remain effective. A delay in enforcing a right is not a waiver of that right.

Governing law and disputes

These Terms are governed by the laws applicable to ARQUEMAR's registered operating entity, without overriding mandatory consumer protections or forum rights in your country of residence.
